These Terms of Service ("Terms") govern your use of the transportation services and online booking platform provided by Calway Express ("we," "us," or "our"). By booking a ride or using our website, you agree to be bound by these Terms. Please read them carefully before completing a reservation.
1. Services
Calway Express provides private chauffeur transportation services in and around the greater Los Angeles metropolitan area. All bookings are subject to vehicle availability and driver availability at the time of confirmation. We reserve the right to decline or cancel any booking at our discretion, in which case any payment collected will be refunded in full.
2. Bookings & Reservations
All reservations are made through our online booking platform or by contacting us directly. A booking is considered confirmed only after you receive a written confirmation email at the address provided during checkout.
- You must provide accurate pickup and drop-off addresses, date, time, and passenger count at the time of booking.
- Flight number information, when provided, is used to monitor flight status for airport pickups. We cannot guarantee accommodation of unannounced flight changes.
- Roundtrip bookings are treated as two separate rides, each with its own confirmation and pricing.
- We reserve the right to adjust pricing if the actual trip differs significantly from the quoted route or passenger count.
3. Payment
Pricing is calculated based on distance, vehicle class, and applicable fees. All prices are displayed in U.S. dollars (USD) and are inclusive of a service fee.
- Payment may be collected at the time of booking via credit or debit card, or at the time of service, depending on the booking option selected.
- Gratuity is optional and may be added during the booking process. Gratuity goes directly to the driver.
- Any promotional codes or discounts applied at checkout are subject to their individual terms and expiration dates.
- In the event of a dispute, please contact us at calwayexpress.com@gmail.com before initiating a chargeback. We are committed to resolving issues promptly.
4. Cancellation Policy
We understand that plans change. Our cancellation policy is as follows:
- More than 2 hours before pickup: You may cancel your booking free of charge through your account portal or by contacting us directly.
- Within 2 hours of pickup: Cancellations within this window may be subject to a cancellation fee, as outlined at time of booking. To discuss late cancellations, please call us at +1 (818) 815-9045.
- No-shows: If the passenger is not present at the designated pickup location within 15 minutes of the scheduled pickup time and has not contacted us, the booking will be considered a no-show and may be charged in full.
- Driver cancellations: In the rare event that we must cancel your booking, you will be notified immediately and any payment collected will be refunded in full.
5. Passenger Responsibilities
By using our services, you agree to:
- Be ready at the designated pickup location at the scheduled time.
- Treat the driver and vehicle with respect. Any abusive, threatening, or discriminatory behavior toward our drivers will result in immediate termination of the ride and may result in a ban from our services.
- Ensure that all passengers, including minors, comply with applicable seatbelt laws and vehicle capacity limits.
- Not consume alcohol, use tobacco products, or consume food or beverages that may stain or damage the vehicle, unless explicitly permitted by the driver.
- Not transport any illegal substances, weapons, or hazardous materials.
- Be responsible for any damage caused to the vehicle by you or members of your party. Cleaning fees starting at $150 may be charged for excessive soiling of the vehicle interior.
6. Limitation of Liability
Calway Express and its drivers maintain all required licenses and insurance in accordance with California law. However, to the fullest extent permitted by applicable law:
- We are not liable for delays caused by traffic, weather, road closures, or circumstances beyond our reasonable control.
- We are not responsible for items left in the vehicle. If you believe you have left an item in one of our vehicles, contact us promptly at calwayexpress.com@gmail.com and we will make reasonable efforts to recover it.
- Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid for the specific booking in question.
- We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
7. Privacy
We collect personal information (name, email, phone number) solely for the purpose of fulfilling your booking and communicating with you about your ride. We do not sell or share your personal information with third parties except as necessary to provide the service (e.g., assigning a driver). 8. Modifications to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after any modification constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
